GENERAL TERMS AND CONDITIONS
This document contains the General Terms and Conditions of a purchase and sale contract between "Advanst" EOOD with UIC: 203764090, Varna District Court, hereinafter referred to as Growshop-Mania.com, on the one hand, and the person who has agreed to these General Terms and Conditions, hereinafter referred to as "Client", on the other hand, in connection with the application and purchase of the goods offered through growshop-mania.com - an electronic store.
GENERAL PROVISIONS:
- Definitions
In interpreting and applying these General Terms and Conditions, the terms and expressions specified below have the following meanings:
1. "Website" is a separate location on the global Internet network, accessible through its unified address (URL) via the HTTP, HTTPS or other standardized protocol and containing files, programs, text, sound, picture, image or other materials and resources.
2. "Advanst" EOOD is the commercial company, with its registered office and management address in the city of Varna, 1 "Yane Sandanski" Str., e-mail: info@growshop-mania.com
3. "www. Growshop-Mania.com" is an e-commerce website, which is a component and separate part of GROWSHOP-MANIA.COM - a virtual information resource on the Internet for the sale of goods remotely, which are delivered after their explicit request by the Client.
4. "Client" is a natural person over 18 years of age or a legal entity that is registered with GROWSHOP-MANIA.COM and has agreed to these General Terms and Conditions.
5. “Customer Profile” is a separate part of GROWSHOP-MANIA.COM, containing information about the Client, provided by the Client upon registration and stored by GROWSHOP-MANIA.COM, and access to the client profile is achieved by entering a username and password. The client profile enables the Client to view and edit the data entered during registration, the entries in the address book, to have access to information about all his requests for purchasing goods from the e-commerce store GROWSHOP-MANIA.COM, to change his access password, to subscribe, respectively to unsubscribe, to receive a newsletter, etc.
6. "Username" is a unique code of letters and/or numbers chosen by the Client, through which he is individualized on GROWSHOP-MANIA.COM.
7. "Password" is a code of letters and/or numbers chosen by the Client, which, together with the username, individualizes the Client and provides him with the opportunity to make valid requests to purchase the goods and services offered on GROWSHOP-MANIA.COM.
8. "Manufacturer" is any natural or legal person who, by profession, produces goods in finished form or substantially modifies or reworks goods with a view to placing them on the market or presents himself as a manufacturer by placing his name or company name, his production or other distinctive sign on the goods, their packaging or on the technical or commercial documentation for them.
9. "Packaging" means containers and any other devices or materials that are suitable for the function of containing and storing various goods offered directly to the Customer.
10. “Sales price” is the final price per unit or for a certain quantity of goods or for a service, including value added tax and all additional taxes and fees.
11. "Fortuitous event" is an unforeseen circumstance of an extraordinary nature at the time of conclusion of the contract, which makes its performance objectively impossible.
12. "Electronic link" is a link indicated on a specific Internet page that allows automated referral to another Internet page, information resource or object through standardized protocols.
13. "Information system / System" is any individual device or set of interconnected or similar devices, which in the execution of a specific program provides or one of the elements of which provides automatic data processing.
14. "IP Address" ("IP address") is a unique identification number associating a computer, Internet page or resource of the Client, in a way that allows their localization in the global Internet network.
15. “Commercial communications” are advertising or other communications presenting, directly or indirectly, the goods, services or reputation of a person carrying out a commercial or craft activity or exercising a regulated profession.
16. "Malicious actions" are actions or omissions that violate Internet ethics or cause harm to persons connected to the Internet or associated networks, sending unwanted mail (unsolicited commercial messages, SPAM, JUNK MAIL), overflowing channels (FLOOD), gaining access to resources with other people's rights and passwords, using flaws in systems for personal gain or obtaining information (HACK), performing actions that may be qualified as industrial espionage or sabotage, damaging or destroying systems or information arrays (CRACK), sending "Trojan horses" or causing the installation of viruses or remote control systems, disrupting the normal operation of other users of the Internet and associated networks, performing any actions that may be qualified as a crime or administrative violation under Bulgarian legislation or other applicable law.
17. "Web page" is a component and separate part of a website.
Subject
GROWSHOP-MANIA.COM provides the Customer with the opportunity to purchase the goods offered in the GROWSHOP-MANIA.COM Store after registration by submitting a request and paying the relevant sales price, subject to the Customer's compliance with and strict compliance with these General Terms and Conditions, as well as with any additional requirements for the specific goods specified on the relevant GROWSHOP-MANIA.COM Internet pages.
Registration
In order to obtain the right to make valid requests to purchase the goods offered on GROWSHOP-MANIA.COM, the Customer must:
· Has correctly filled out the online electronic registration form, located at the Internet address – www.growshop-mania.com
When filling out the electronic registration form, the Client is obliged to provide complete and accurate data regarding his/her identity and other data required by the electronic form of GROWSHOP-MANIA.COM, as well as to update them within 7 days of their change. The Client guarantees that the data he/she provides during the registration process are true, complete and accurate and, if the latter changes, he/she will update them in a timely manner.
In the event that a Client of GROWSHOP-MANIA.COM provides incorrect data or changes that have occurred within the period under the previous paragraph are not reflected, GROWSHOP-MANIA.COM has the right to immediately and without notice suspend the maintenance of the Client's registration and access to his client profile.
Before making the statement, the Client may freely correct the information entered by him in the registration form.

After expressing agreement with these General Terms and Conditions, the Customer may make valid purchase requests (purchase requests) for the goods offered through GROWSHOP-MANIA.COM, is considered bound by the clauses of the General Terms and Conditions and undertakes to comply with them.
In the event of a dispute as to which person has expressed the will to be bound by the text of these General Terms and Conditions, the person who has paid the price of the goods requested for purchase shall be considered a party to the contract.
Changes to the Terms and Conditions
To the extent that the goods offered by GROWSHOP-MANIA.COM are diverse and constantly supplemented and modified with a view to their improvement and expansion of the product catalog, as well as in connection with legislative changes that reflect on the conditions for their offering, these General Terms and Conditions may be changed unilaterally by GROWSHOP-MANIA.COM.
When making changes to the General Terms and Conditions, GROWSHOP-MANIA.COM undertakes to notify the Client by sending to his e-mail and/or publishing in a prominent place on GROWSHOP-MANIA.COM or in his client profile a message about the amendment to the General Terms and Conditions, the text of the amendments or an electronic link to a website where the amended General Terms and Conditions are available and giving him sufficient time to familiarize himself with them.
The changes to the General Terms and Conditions do not affect the relationship between the Client and GROWSHOP-MANIA.COM arising in connection with a validly submitted prior to the notification request for the purchase of goods.
Publishing information about goods on GROWSHOP-MANIA.COM
GROWSHOP-MANIA.COM publishes at http://www.growshop-mania.com/ a description of the main characteristics and an image of each product, the sales price, including VAT, as well as a tariff for the value of postal or transport costs not included in the price of the goods, related to their delivery, information on the methods of payment, delivery and performance of the contract, on the right of the Customer, who is a consumer within the meaning of the Consumer Protection Act and on the conditions and manner of exercising it, as well as the period for which the offer and price made remain valid.
GROWSHOP-MANIA.COM is not responsible for the inaccuracy of the information provided by the manufacturer about the characteristics of the product.
Purchase request
The customer gains access to the form for submitting purchase requests for the goods offered on GROWSHOP-MANIA.COM after entering a valid username and password in the appropriate places on the GROWSHOP-MANIA.COM website and pressing the virtual "Login" button.
The submission of a purchase request by the Client is carried out by sequentially performing the following actions:
· determining the type and quantity of the goods and confirming the request by pressing the virtual "Buy" button, indicated against the relevant goods;
· review of delivery information (possibility to change the delivery address, specify a convenient delivery time and specify additional conditions for the order.
· choosing a method of payment for the sales price of the goods and entering/changing the data for issuing an invoice;
The request to purchase goods from GROWSHOP-MANIA.COM is considered completed after clicking the "Complete order" button.
If an incomplete, incorrect or wrong address and/or telephone number is provided when submitting the application, it is considered invalid and GROWSHOP-MANIA.COM has no obligation to fulfill it.
Accepting the request
The purchase request is accepted by GROWSHOP-MANIA.COM by sending a message to the Customer's e-mail address for correspondence, which contains: information about the main characteristics of the requested product, its sales price, the value of postal or transport costs not included in the sales price and related to its delivery, the payment method chosen by the Customer, the specified invoice data and delivery address. The request becomes effective between the parties after checking the availability of the product requested for purchase and after confirming its validity on the contact phone number specified by the Customer or by sending a message to his e-mail address for correspondence.
Prices
All prices at GROWSHOP-MANIA.COM are in Bulgarian leva, including VAT.
The prices of individual goods indicated on GROWSHOP-MANIA.COM are per unit quantity and do not include delivery costs.
The sales price payable by the Customer is the one indicated in the invitation to purchase the goods at the time of submitting the purchase request.
Payment methods
The price under Art. 10 and the delivery costs can be paid in any of the following ways:
· in cash by the Client or by a third party on behalf of the Client;
· by bank transfer to an account specified by GROWSHOP-MANIA.COM;
· with a credit or debit card;
· in another manner specified on the GROWSHOP-MANIA.COM website.
A customer who is a consumer within the meaning of the Consumer Protection Act is obliged to pay the sales price of the goods purchased by him, as well as the postal or transport costs not included in this price, related to its delivery, within a period not later than 3 working days from the expiration of the period under Art. 14, para. 4 of the Consumer Protection Act.
Delivery
The goods requested for purchase are delivered to the delivery address specified by the Customer within the following time frame:
· up to 3 business days.
· sufficient according to the circumstances - for abroad.
The goods are delivered appropriately packaged according to their type and the delivery transport.
- Delivery of the goods
The goods are transferred to the Customer or to a third party who accepts and confirms receipt of the same on behalf of the Customer.
Upon delivery of the goods, the Customer or the third party signs the accompanying documents.
In the event that the Customer is not found within the delivery period at the address specified by him or access and conditions for delivery of the goods are not provided within this period, GROWSHOP-MANIA.COM is released from its obligation to deliver the goods requested for purchase. The Customer may confirm his desire to receive the goods even after the expiry of the delivery period in which he was not found at the address, by assuming all delivery costs. In this case, a new delivery period shall start to run from the moment of confirmation under the previous sentence.
Delivery of products
The ordered goods are delivered by a courier company to the delivery address specified by the customer in accordance with the specified and these General Terms and Conditions.
Delivery time
The delivery time depends on the service schedule of the settlement according to the forwarder's estimate. The average delivery time is 1-2 business days.
If the product is not in stock (especially in cases of out-of-stock imports or insufficient production), the period may be significantly longer. In case of high demand or unforeseen difficulties in processing orders, the period may also be extended.
In the event of circumstances leading to a delay in the execution of the order, the client will be notified in a timely manner at the specified contact telephone number.
Right of withdrawal
The customer has the right to refuse to receive the goods requested for purchase when:
· the delivered goods clearly do not correspond to the goods requested for purchase by the Customer and this can be established through a simple inspection;
· the goods or their packaging were damaged during transportation;
· the price that the Customer should pay does not correspond to the price due;
A customer who is a consumer within the meaning of the Consumer Protection Act has the right, without owing compensation or penalty and without giving a reason, to withdraw from the concluded contract for the purchase of goods through GROWSHOP-MANIA.COM by returning the goods within 14 days from the date of receipt. In the event that the customer withdraws from the concluded contract within the period specified in the previous sentence, he should send a statement of withdrawal from the concluded contract to GROWSHOP-MANIA.COM and return the goods in a condition that allows their re-offering, unless testing is necessary to establish their characteristics and functioning.
Upon receipt of the shipment, check the contents of the package for compliance of the sent goods with the submitted order.
If any violations are found in the appearance of the goods, contact the courier, who is obliged to draw up a report of damage to the shipment.
Rights and obligations of GROWSHOP-MANIA.COM
GROWSHOP-MANIA.COM undertakes:
· to transfer ownership of the goods requested for purchase to the Customer;
· to deliver the goods requested for purchase on time;
· to exercise due care in the performance of his/her duties;
GROWSHOP-MANIA.COM has the right to:
· to install cookies on the Client's computers - small text files that are saved by the Internet page via the Internet server on the Client's hard drive and enable the recovery of information about the Client, identifying him and tracking his actions.
· to place electronic links to other Internet pages and resources and advertising banners for the sale of goods and provision of services by third parties, including electronic links and advertising banners pointing to websites outside the control of GROWSHOP-MANIA.COM. GROWSHOP-MANIA.COM reserves the right to place electronic links and advertising banners pointing to websites outside the control of GROWSHOP-MANIA.COM and in the Client's client profile.
· to send unsolicited commercial messages to the Client in order to offer information and advertisements regarding its own or other merchants' goods and/or services, as well as to make inquiries on various issues, conduct surveys, etc.
GROWSHOP-MANIA.COM is not obligated to provide computer equipment and connectivity for the transfer of information packets between the Client and GROWSHOP-MANIA.COM, necessary for accessing the system resources. GROWSHOP-MANIA.COM is not responsible if the Client cannot access due to problems beyond the control of GROWSHOP-MANIA.COM (hardware or software problem, Internet connectivity problem, etc.).
Limitation of liability
GROWSHOP-MANIA.COM takes care to ensure that the information in the store is always kept accurate and up-to-date, but does not guarantee its accuracy and completeness.
GROWSHOP-MANIA.COM is not responsible for not providing access to the store, as well as for not processing or untimely processing of purchase requests, in the event of circumstances beyond its control - cases of force majeure, random events, problems in the global Internet network and in the provision of services beyond the control of GROWSHOP-MANIA.COM.
GROWSHOP-MANIA.COM does not guarantee that access to the store will be uninterrupted, timely, secure and error-free, as this is beyond the capabilities, control and will of GROWSHOP-MANIA.COM.
To the extent that GROWSHOP-MANIA.COM does not have the ability to change, control or otherwise influence the quality and suitability for use of the goods requested by the Customer, GROWSHOP-MANIA.COM is not responsible for their compliance with the applicable regulatory requirements and their qualities.
GROWSHOP-MANIA.COM is not responsible for any damage caused to software, hardware or telecommunications equipment, or for any loss of data resulting from materials or resources searched for, downloaded or used in any way through GROWSHOP-MANIA.COM.
To the extent that it does not have the objective possibility and obligation and does not control the Internet pages and resources made accessible through the electronic links and advertising banners placed on GROWSHOP-MANIA.COM and in the Client's client profile, GROWSHOP-MANIA.COM is not responsible for the illegal nature of the content and materials located on these Internet pages and resources. GROWSHOP-MANIA.COM is not responsible for any damages suffered and lost profits resulting from the use, access or unreliability of these materials and content.
GROWSHOP-MANIA.COM does not have the obligation and objective ability to control the way the Customer uses the store.
Client's rights and obligations
The client undertakes:
· to provide an accurate and valid telephone number, delivery address and e-mail address for correspondence;
· to pay the price of the goods he requested;
· to pay the delivery costs;
· to receive the goods;
· to take all reasonable care and take all necessary measures to protect your password;
· not to disclose your password and the answer to the secret question to third parties and to immediately notify GROWSHOP-MANIA.COM in the event of unauthorized access to your customer account, as well as in the event of a likelihood of such;
· in view of the specifics of Internet protocols and the security of password data protection, to terminate the session in which he has logged into his client profile by pressing the virtual "logout" button.
· not to submit fictitious or invalid applications or other false information.
The client is fully responsible for protecting his password, as well as for all actions taken by him or a third party using it.
- The client has the right to:
1. online access to GROWSHOP-MANIA.COM, subject to the terms and conditions of access set by GROWSHOP-MANIA.COM. In order to submit valid requests for goods, the Customer must enter his username and password.
2. access and correction of your personal data online.
By accepting these General Terms and Conditions, the Customer agrees to receive unsolicited commercial communications from GROWSHOP-MANIA.COM.
- The client undertakes when using GROWSHOP-MANIA.COM:
· to comply with Bulgarian legislation, these General Terms and Conditions, Internet ethics, the rules of morality and good manners;
· not to violate other people's property or non-property rights, including intellectual property rights;
· to immediately notify GROWSHOP-MANIA.COM of any case of committed or discovered violation when using the store;
· not to interfere with the proper operation of the system, including, but not limited to, not to thwart the identification procedure of another Customer, not to access beyond that granted to him, not to prevent other Customers from using the store, as well as not to use the store in a manner that causes a denial of service;
· not to extract by technical means or in a technical manner information resources or parts of information resources belonging to the databases located on GROWSHOP-MANIA.COM and thus not to create your own database in electronic or other form;
· not to impersonate another person or representative of a legal entity or group of people whom he is not authorized to represent, or otherwise mislead third parties regarding his identity or his affiliation with a particular group of persons;
· not to commit malicious acts within the meaning of these General Terms and Conditions.
In case of non-compliance with the obligations under the previous paragraph, GROWSHOP-MANIA.COM has the right to immediately and without prior warning suspend the access of the Client and third parties to his client profile, as well as the right to compensation for all damages suffered and lost profits that are a direct and immediate consequence of the Client's failure to fulfill the obligations under the previous paragraph. In these cases, GROWSHOP-MANIA.COM has the right to notify the competent state authorities to establish the relevant violation.
Personal data
GROWSHOP-MANIA.COM has the right to collect and use information about its Customers when they register. The information through which a Customer of the store can be identified may include name, surname, last name, address, profession, gender, age group, telephone number, e-mail address for correspondence and any other information that the Customer provides upon registration and any other information that the same enters or provides when requesting, receiving or using the services provided by GROWSHOP-MANIA.COM, participating in promotions, raffles and competitions, filling out questionnaires, questionnaires, forms and others.
Processing of Customer Information
GROWSHOP-MANIA.COM exercises due care and is responsible for protecting the information about the Customer that has become known to him/her in connection with the purchase and sale of goods through the store - subject to these General Terms and Conditions, except in cases of force majeure or a fortuitous event.
In the registration form filled out by the Client upon registration, GROWSHOP-MANIA.COM indicates the mandatory or voluntary nature of providing the data and the consequences of refusing to provide it. By expressing agreement with these General Terms and Conditions, the Client agrees to have his information processed in the manner provided for therein.
The restrictions do not apply in the event that the Client or persons under his control have committed malicious acts within the meaning of these General Terms and Conditions or have violated the rights or legitimate interests of third parties. In this case, GROWSHOP-MANIA.COM has the right to provide the personal information of the Client to the relevant competent state authorities in accordance with the current legislation.
Purposes for which the information may be used
GROWSHOP-MANIA.COM collects and uses information for the purposes provided for in these General Terms and Conditions, as well as for offering new goods and/or services to the Client (free or paid), for offering goods and/or services offered by other persons, for promotions, for organizing raffles, inquiries, surveys, for adapting the services offered to the preferences of the portal member, for statistical and other purposes.
By accepting these General Terms and Conditions, the Client agrees to the processing of his personal data for direct marketing purposes. The Client has the right to object to the processing of his personal data for direct marketing purposes by sending a written message to GROWSHOP-MANIA.COM at the specified address or e-mail for contacts (info@growshop-mania.com).
By accepting these General Terms and Conditions, the Client is deemed to be notified within the meaning of Art. 34a, item 3 of the Personal Data Protection Act that his personal data may be disclosed to third parties in compliance with the applicable legislation or used on their behalf for the purposes of direct marketing, and may object to such disclosure or use at any time by sending a written message to GROWSHOP-MANIA.COM at the specified address or e-mail for contacts (info@growshop-mania.com).
All the purposes described above for which the information may be used are not exhaustive and do not create obligations for GROWSHOP-MANIA.COM. Any other purposes for which the information is used will be in accordance with Bulgarian legislation, applicable international acts, Internet ethics, rules of morality and good manners.
Disclosure of information
GROWSHOP-MANIA.COM undertakes NOT to disclose any personal information about the Client and not to provide the collected information to third parties - government authorities, commercial companies, individuals and others, except in cases where:
a) has received the Client's express consent upon registration or at a later time;
b) the information is requested by state authorities or officials who, according to the current legislation, are authorized to request and collect such information in compliance with the legally established procedures;
c) in other cases specified in the law.
GDPR policy
The Growshop mania website collects a series of general data and information when a data subject or an automated system calls up the website. This general data and information is stored in server log files. The collected may be (1) the browser types and versions used, (2) the operating system used by the accessing system, (3) the website from which it reaches our website (so-called referrers), (4) (5) the date and time of access to the website, (6) the Internet Protocol address (IP address), (7) the Internet service provider of the accessing system and (8) any other similar data and information that can be used in the event of attacks on our information technology systems. When using this general data and information, Growshop Mania does not draw any conclusions about the data subject. Rather, this information is necessary to: (1) properly make the content of our website, (2) optimize the content of our website as well as its advertising, (3) ensure the long-term viability of our information technology and web technologies, and (4) provide law enforcement authorities with the necessary information for criminal prosecution in the event of a cyber attack. Growshop mania therefore analyzes the anonymously collected data and information statistically, in order to increase the data protection and data security of our enterprise and to ensure an optimal level of protection for the personal data we process. The anonymous server log data is stored separately from any personal data provided by the data subject.
Termination
Upon termination of the contract, GROWSHOP-MANIA.COM deactivates the customer account and deletes the password for accessing the customer account.
The Customer may at any time request GROWSHOP-MANIA.COM to delete his/her customer account. In this case, the deletion of the customer account shall be carried out immediately after the fulfillment of all validly submitted orders by the Customer and the respective payment by the Customer of the due sales price and delivery costs.
Except in the cases provided for in these General Terms and Conditions, the contract between the parties shall also be terminated upon the occurrence of any of the following circumstances:
1. cessation of the activities of GROWSHOP-MANIA.COM;
2. termination of the store maintenance; or
3. in other cases provided for by law.
Breach of contract
- Outside of the cases specified above in these General Terms and Conditions, either party may terminate the contract by giving one week's notice to the other party in the event of non-fulfillment of the obligations under the contract.
Compensation
- The Client is obliged to indemnify GROWSHOP-MANIA.COM and all third parties for all damages suffered and lost profits, including any costs and paid attorney's fees, arising as a result of claims filed by and/or compensation paid to third parties in connection with failure to fulfill its obligations under this contract, violation of Bulgarian legislation, applicable foreign laws, these General Terms and Conditions, good morals or Internet ethics.
- The client is obliged to compensate GROWSHOP-MANIA.COM for all damages caused by third parties to whom he has provided his password, when using it.
GROWSHOP-MANIA.COM is obliged to compensate the Customer for all damages caused by GROWSHOP-MANIA.COM intentionally or through gross negligence.
Invalidity
- The parties declare that in the event that any of the clauses under these General Terms and Conditions prove to be invalid, this shall not entail the invalidity of the contract, other clauses or parts thereof. The invalid clause shall be replaced by the mandatory provisions of the law or established practice.
Dispute resolution
All disputes between the parties shall be resolved in a spirit of understanding and good will. In the event that no agreement is reached, all unresolved disputes arising from or relating to the contract between the parties, including disputes arising from or relating to its interpretation, invalidity, performance or termination, as well as disputes to fill gaps in the contract or adapt it to newly arising circumstances, shall be resolved by judicial procedure by the competent court in the city of Varna.
Written form
The written form is considered to be complied with by sending an e-mail, pressing an electronic button on a page with content that is filled in by the Client or marking a field (check box) on the GROWSHOP-MANIA.COM website, etc. similar, as long as the statement is technically recorded in a way that allows it to be reproduced.
Intellectual property rights
The intellectual property rights on all elements and resources located on the e-commerce website GROWSHOP-MANIA.COM - http://growshop-mania.com (including the available databases) are subject to protection under the Copyright and Related Rights Act, belong to "Advanst" EOOD or to the respective designated person who has transferred the right to use GROWSHOP-MANIA.COM, and cannot be used in violation of current legislation.
The Client's right of access does not include the right to copy or reproduce information and to use intellectual property objects, except for insignificant amounts of information intended for personal use, provided that the legitimate interests of the authors or other holders of intellectual property rights are not unreasonably prejudiced and in the event that the copying or reproduction is carried out for non-commercial purposes. Notwithstanding the above, the Client does not have the right to remove trademark signs and other intellectual property rights from the resources accessible to him, regardless of whether the holder of the relevant rights is GROWSHOP-MANIA.COM or a third party.
In case of copying or reproduction of information outside the permissible limits, according to the previous paragraph, as well as in case of any other violation of intellectual property rights on the resources of GROWSHOP-MANIA.COM, the Client owes GROWSHOP-MANIA.COM a penalty in the amount of 3,000 (three thousand) leva for each individual violation. The specified amount of the penalty does not deprive GROWSHOP-MANIA.COM of the right to claim compensation for damages greater than the amount of the penalty.
Applicable law
For issues not regulated by these General Terms and Conditions, the provisions of the current legislation of the Republic of Bulgaria shall apply.
